The regime

A capped-tax residence status for high net worth individuals.


Instead of Gibraltar tax on worldwide income, a Category 2 individual is taxed only on a fixed tranche of income. The result is a predictable annual tax bill within a narrow band, whatever the real income. Status is governed by the Qualifying (Category 2) Individuals Rules 2004 under the Income Tax Act 2010, and evidenced by a certificate from the Finance Centre Director.

Getting the certificate

Application and timeline


01Apply to the Finance Centre Director through an approved Gibraltar intermediary.
02Submit CV, passport, evidence of net worth, two references, medical cover and approved accommodation.
03Pay the £5,000 non-refundable application fee.
04Approval typically within one to two weeks of a complete file; sourcing accommodation is the longer lead item.
05The Finance Centre Director issues the Qualifying (Category 2) Certificate: the operative document.

There is no minimum-days requirement to obtain or keep the status.

Keeping the status


Maintain qualifying accommodation Exclusive-use approved home in Gibraltar throughout every tax year. Letting it out jeopardises status.
No business in Gibraltar No trade or employment locally, save for limited activities the Finance Centre Director approves as beneficial.
File and pay annually Lodge the annual return and pay the capped tax via payments on account and final settlement.
Status can be lost Losing the accommodation, breaching the no-business rule or non-payment ends the status, and with it the right to reside.

Beyond the tax cap

From a residence card to permanent residence.


Annual Civilian Registration Card The right to reside, renewed yearly. Conditional: it lapses if Cat 2 status is not maintained.
10 yrs Permanent residence Continuous, genuine residence. Doubled from 5 to 10 years in the October 2025 reform.
20 yrs Gibraltarian status The fullest local status. Now needs British citizenship plus 20 years (was 10).

Cat 2 does not auto-escalate. Each rung is a separate application built on real residence. Residents settled before 6 October 2025 are grandfathered on the shorter timelines.

What naturalisation demands
  • Absences capped at 450 days over 5 years, and 90 days in the final year
  • Good character, good English, and intention to reside in Gibraltar
  • BOTC naturalisation is discretionary; registering as a British citizen is then an entitlement, and that status (not BOTC) carries full UK right of abode

Cat 2's "no minimum days" is the very feature that stalls the citizenship clock. Naturalisation needs real, continuous physical presence. Cat 2 is a tax status, not a shortcut to a passport.

As at July 2026. Gibraltar's October 2025 reform doubled permanent residence to 10 years for new residents (those settled before 6 October 2025 keep the 5-year path), pushing the realistic timeline toward 10 years. BOTC naturalisation itself is UK statute (BNA 1981), unchanged.

Bringing the family


Spouse and minor children: covered The approved home is for exclusive family use. Spouse and dependent unmarried children (to 18, or end of higher education) can join the certificate. Spouse needs a social-insurance contribution; unmarried partners need a two-year durable relationship.
Adult children and parents: mostly excluded The October 2025 policy narrows dependants to spouse and children and drops the "dependant" concept. Including adult children or parents now rests on discretion and strong evidence.
Private schooling and healthcare Cat 2 gives no publicly funded schooling or healthcare. Plan for mandatory private medical insurance and private schooling for the family.
Each member's own clock Permanent residence and citizenship time accrue only through each person's own genuine residence, not the principal's certificate.

Recent developments

The Spain border comes down.


15 July 2026 treaty provisional application
Routine checks at the La Linea land border are removed; the fence is dismantled and the roughly 15,000 daily frontier workers cross freely.
Schengen entry and exit checks move to Gibraltar's airport and port, under a dual Spain (Frontex) and Gibraltar model.
Gibraltar becomes a separate customs territory aligned with the EU customs code; a transaction tax phases in.
Sequence: political deal June 2025, member states greenlight April 2026, treaty signed 14 July 2026.

Expectation of the border deal drove a surge of interest in Gibraltar residence through 2025 and 2026.
October 2025: Gibraltar froze new general residency applications, but Cat 2 and other economic routes were carved out and stayed open, so this was a reprice, not a closure.
June 2026: the higher Cat 2 thresholds took effect; existing holders are fully grandfathered at the old level.

Direction of travel: demand up, access tightening. Gibraltar is repricing upward to filter for genuine economic contributors, while protecting incumbents.
